1. Scope of application

 

The following General Terms and Conditions regulate the subscription to magazines offered by the publishing company Deutscher Levante Verlag GmbH.
When entering into a subscription delivered by Deutscher Levante Verlag GmbH, it is considered that the subscriber has accepted these conditions. Our General Terms of Business and Delivery accepted by the Customer, at the time of order, apply exclusively. No other General Terms and Conditions than these GTC shall be part of any contract. Customers can download our General Terms of Business and Delivery to their computer and then print or save it with the help of Adobe Acrobat Reader.

 

2. Order and contract

 

The Customer’s order constitutes a binding offer, which can be accepted by Deutscher Levante Verlag GmbH, at the latest, in kind of delivery. There is no entitlement to conclusion of the contract. The publishing company Deutscher Levante GmbH is entitled to reject orders without stating reasons.

 

3. Price, delivery and performance

 

The cost of a yearly subscription within Germany amounts to 34 euros, including the legally applicable sales tax of currently 7%. The cost of annual subscription for deliveries outside Germany amounts to 45 euros, including the legally applicable sales tax of currently 7%. Shipping costs do not incur separately, both in terms of   
domestic procurement transactions and in terms of foreign procurement transactions. Shipping costs are paid by the publishing company Deutscher Levante Verlag Gmbh. Delivery is generally scheduled to start with the first subsequent issue of the magazine zenith after the receipt of the Customers order.

 

Further deliveries are made after the respective date of publication. The type of delivery is entirely up to Deutscher Levante Verlag GmbH. The Customer is obliged to inform our customer service without delay about any objections or irregularities occurring in the course of carrying out his contractual duties at the following address:

a) in written form to: Deutscher Levante Verlag GmbH, Chausseestraße 11, D-10115 Berlin or

b) by fax: 030-39 835 188 5,

c) by e-mail: kundenservice(at)levante-verlag.de.

 

In case of non-delivery, delayed deliveries or damage to property in the course of delivery the publishing company Deutscher Levante Verlag GmbH shall only be liable for intent or gross negligence.

 

4. Contract term and termination of the contract

 

A subscription with Deutscher Levante Verlag is valid for one complete calendar year and automatically renewed for another year, as far as the contract is not cancelled in written form (by post, e-mail or fax) 6 weeks before the end of the reference period. To meet the deadline it is sufficient for the Customer to send the notice of termination in time. The notice of termination can be sent to:

a) in written form to: Deutscher Levante Verlag GmbH, Chausseestraße 11, D-10115 Berlin or

b) by fax: 030-39 835 188 5,

c) by e-mail: kundenservice(at)levante-verlag.de.

 

5. Payment and exaction

 

The cost of annual subscription is due immediately after issuing of the invoice and to be paid in advance. Deutscher Levante Verlag GmbH debits the cost of annual subscription from the Customer’s account by direct debit. Should the deadline for payment stated in the invoice be exceeded the Customer shall default in payment without any further reminder, according to Article 286 Paragraph 3 German Civil Code. This also applies if a direct debit from the Customer’s account is not possible due to reasons the Customer is responsible for. In the case of a return debit note Deutscher Levante Verlag GmbH debits the Customer’s account in the amount of the actual costs resulting from any return debit note. However, the Customer is free to establish that either no costs have been incurred or that significantly lower costs than the fixed amount have been accrued through the return debit note. For each reminder subsequent to any occurrence of default we issue, an administration fee of 3 euros shall be agreed and paid to Deutscher Levante Verlag GmbH. The Customer is free to establish that either no costs have been incurred or that significantly lower costs than the fixed amount have been accrued.

 

6. Adjustment of the subscription price

 

Deutscher Levante Verlag GmbH is entitled to adjust the subscription price at any time for future effect if and to the extent that the publishing company increases the selling price for retail magazine sales. In addition, Deutscher Levante Verlag is entitled to increase once yearly the price due to increases in the cost of paper, printing, labour or distribution. This declaration can be made and sent to the Customer in written form or by e-mail. In the case of price increases the Customer may terminate the contract vis-à-vis the publishing company for good cause within a period of one month after receipt of the corresponding written declaration. The termination declaration shall be sent to:

a) in written form to: Deutscher Levante Verlag GmbH, Chausseestraße 11, D-10115 Berlin or

b) by fax: 030-39 835 188 5,

c) by e-mail: kundenservice(at)levante-verlag.de. The termination will become effective on the announced date of price increase.

 

7. Data and data protection

 

The Customer affirms and shall undertake to ensure that all information provided by him is true, complete and correct. The Customer commits himself to inform Deutscher Levante Verlag GmbH promptly of changes of all existing contract data, in particular any changes in the Customer’s address or banking details.

 

Particularly with regard to non-delivery or a delay in delivery Deutscher Levante Verlag GmbH assumes no liability for any failure to provide changed addresses for service to the publisher. Deutscher Levante Verlag GmbH always takes into account the legitimate interests of their Customers in terms of data processing and data application in accordance with the law.

 

The publishing company processes the Customer’s data exclusively for winding up of an agreement and, if necessary passes the data on to service providers (e.g. distributors) in relation to this end. Any ulterior use of the Customer’s data does not take place.

 

8. Final provisions

 

The relationship between Deutscher Levante Verlag GmbH and the Customer shall be governed by German law, to the exclusion of the ‘United Nations Conventions on contracts for the international sale of goods’ (the ‘Vienna Sales Convention’). If the customer is a businessman or public service special asset the sole place of performance and jurisdiction for all disputes arising from and in connection with this agreement is Berlin.
